Date: Thu, 16 Sep 1993 12:29:10 -0500 1994-208 Legend Hill Properties LP RESOLUTION NO. 20599 A RESOLUTION APPROVING A FINAL PLANNED UNIT DEVELOPMENT SUBMITTED BY LEGEND HILL PROPERTIES LP ON A TRACT OF LAND LOCATED AT 1935 JENKINS ROAD, BEING ON THE NORTHWEST LINE OF JENKINS ROAD NORTHEAST OF IGOU GAP ROAD, SUBJECT TO CERTAIN CONDITIONS. _________________________ BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That the Final Planned Unit Development attached hereto as submitted by the Legend Hill Properties LP be and the same is hereby approved for the following tract of land: A tract of land located at 1935 Jenkins Road, being on the northwest line of Jenkins Road northeast of Igou Gap Road. Lot 1, Legend Hills Subdivision, as shown by plat of record in plat book 52, page 110, ROHC; being the properties described in deed book 4334, page 339, ROHC, and deed book 4334, page 341, ROHC. Tax Map No. 159B-B-1 and 159B-C-4. BE IT FURTHER RESOLVED, That this approval shall be subject to the following conditions: 0C A. Planning Commission Requirements 1. Delete contour lines. These lines are useful for preliminary review but make the recorded instrument difficult to read. 2. Show on the "Cronaflex" copy of the final P.U.D. and install a fire hydrant at each of the three locations given below. Alternative locations are given so that fire hydrants can be installed on the same side of the road as water lines. a. in lots 34 or 62 at the intersection b. in lots 12 or 19 at the intersection c. at the lot line between lots 41 and 42 or the lot line between lots 52 and 53. 3. Label both existing and new sanitary sewer easements as 20' wide. 4. Add a 20' sanitary sewer easement in lot 13 along the proposed sewer line from Twin Branch Lane. 5. Show a 20' drainage easement for the stream in lots 12-15, 31, 32, 35, 36 and 59. 6. Show the deed book and page number for the area subdivided. 7. In note 7 change "Hamilton County" to "Chattanooga". 8. Show 15' drainage easements where pipes cross lots and in the rear of lots 45 and 46. If a lesser width easement is desired, have Mr. Tom Scott contact Planning Commission staff that this is acceptable. 9. Show exact bearings for all lot lines and straight road segments. 10. Add the following engineer's statement and have it signed by an engineer: "I certify that I have reviewed or designed all new roads, drainage, domestic water and sanitary sewers as shown on this plat and that the design meets proper engineering criteria". Add the seal of the engineer. 11. Delete station numbers and marks. Delete point of curve station numbers. 12. Add the following note: "100 year flood elevations vary from 717' at Igou Gap Road to 723' at Jenkins Road. 13. Add the following note: "No residential building permit is permitted on Community Lots 59 or 64". 14. Record the "Cronaflex" copy of the final P.U.D. within two years of Final City Council approval. 15. Label Ponds as "Drainage Detention Ponds". 16. Add the following note and refer to the number of this note in the existing sewer line to be abandoned in lots 13-15 on the plat: "The existing sewer easement to be abandoned in existing sewer easement to be abandoned in lots 13-15 must be abandoned by the Chattanooga City Council after mandatory referral action by the Chattanooga-Hamilton County Regional Planning Commission". 17. In the title block area, label the plat as in the City of Chattanooga, Hamilton County, Tennessee. 18. Show the center line curve data for interior roads. 19. Add the following note: "The developer is responsible to maintain Community Lots 59, 63 and 64 until they are deeded to lot owners in the subdivision or a lot owners association. 20. Show bearing and distance for the north line of lot 63. 21. Show the size and acres drained for the two drainage pipes that carry the stream below the roads. 22. Show the size of pipes from drainage detention ponds. 23. Label roads as "private". 24. Delete dedication statement from Owner's Certification. 25. Add the following note: "The City of Chattanooga is not responsible for construction or maintenance of roads in this subdivision. All roads in this subdivision are private". 26. Sidewalks are required per Chattanooga Zoning Ordinance. 27. Per Resolution 20359 and the Chattanooga Zoning Ordinance, all streets must be built to City standards. 28. Label the plan as "Final Planned Unit Development Plan" and delete "Preliminary Plat". B. Chattanooga Storm Water Management Requirements 1. Add the following note: "Drainage Detention Ponds that are installed by the developer cannot be altered, filled or changed in any way without approval by the Chattanooga Storm Water Management Division". 2. Install oil skimmer-grit collector structures in Legend Way in the last structure before water enters the drainage detention ponds. 3. Dig drainage detention ponds deeper to be used as sediment ponds during construction. There must be 67 cubic yards of sediment volume per acre disturbed. 4. Submit drainage calculations to determine the necessary volume of detention ponds. There must be sufficient detention to detain any increase in drainage volume due to development. 5. A Pollution Control Program and pollution control permit are required before this plat can be recorded. The Pollution Control Program must have a plan for home owner association maintenance of drainage detention ponds and facilities. 6. An erosion and sedimentation control plan and permit are required before any land disturbing activity. 7. Do not disturb the floodway area in any way. 8. The stream through lots 12-15, 31, 32, 35, 36 and 59 is a State Water. Because of this, an A.R.A.P. (Aquatic Resource Alteration Permit) is required from the State of Tennessee. 9. Since there are more than five acres in this subdivision, an N.P.D.E.S. (National Pollutant Discharge Elimination System) Permit is required. Please contact Mr. Tom Scott about this permit. 10. Questions about Chattanooga Storm Water Management requirements should be directed to Mr. Tom Scott at 785-7995. C. Chattanooga City Engineer's Office Requirements 1. Submit a C.B.R. test to determine the type of base and subbase required. Based on past experience, it will probably be necessary to under cut all of the roads at least 2' and refill with suitable material. 2. Where the roads are located near the stream in the area of lots 12-15, 31, 32, 35, 36, 59 and 60 there are hydric soils. Roads cannot be built on hydric soils. All hydric soils in the roads must be removed to bedrock and the road base formed by suitable material. 3. Road construction cannot begin until the Storm Water Management Division has agreed that all their requirements have been met. 4. The Chattanooga Sign Ordinance requires a permit for subdivision entrance signs. Please contact Mr. Leroy Lewis at 757-5105 if an entrance sign is desired. 5. Sewer design must be approved by the Chattanooga City Engineer's Office and the State of Tennessee. 6. Show survey data for the location of drainage detention ponds. 7. Questions about Chattanooga City Engineer's Office requirements should be directed to Mr. Joel Booth at 757-4886. D. Tennessee Department of Health Requirements 1. Under current policies, the "Cronaflex" copy of the final plat cannot be recorded until the Tennessee Department of Health, Division of Water Supply, has approved public water line extensions. E. Utility Requirements 1. Show 10' Power and Communication Easements along both sides of all interior roads. Easements along Igou Gap Road and Jenkins Road will not be necessary. F. Chattanooga Traffic Engineer's Office Requirements 1. Add the following note: "No access to lots 47-50 from Jenkins Road and no access to lots 63 and 64 from Igou Gap Road". 2. Dedicate additional right-of-way to 40' from center line of Igou Gap Road. 3. Questions about Traffic Engineer's Office requirements should be directed to Mr. John Van Winkle at 757-5005. G. Special Notice 1. No revised or corrected final plat is required. Please cover the specified conditions in the preparation of the "Cronaflex" copy of the final plat for recording. 2.
